Terms of Service

These Terms of Service govern your use of the Harmiqa platform (harmiqa.com). By using the service or creating an account you accept these terms. Please read them carefully.
1. Parties and Service
This agreement is between "Harmiqa" (hereafter "Service" or "we") and the natural or legal person using the service ("User" or "you"). The Service is a SaaS platform offering farm accounting, field management, inventory tracking, planning and reporting features designed for farmers.
2. Account and Eligibility
To create an account you must be at least 18 years old and provide a valid email address. You are responsible for keeping your credentials confidential and for all activity carried out through your account. Multiple users may not share a single account; each user must register their own account.
3. Subscription: Free and Premium
The Service is offered in free ("Free") and paid ("Premium") tiers. Free includes one farm with unlimited fields and parcels, basic equipment records, finance and stock activity, production and labor records, manual planning, and basic reports. Premium adds higher usage limits, equipment maintenance and media storage, contract tracking, agronomy insights, past-budget comparisons, and advanced reports. - Feature scope and limits may change; material changes are announced to users in advance via email or in-app notification.
4. Payment, Renewal, Cancellation and Refunds
Premium subscriptions are charged in advance, monthly or annually. Paddle acts as Merchant of Record and handles checkout, payment, applicable taxes and invoicing; we do not store your card details. Subscriptions renew automatically at the end of each period. You can stop renewal at any time from the subscription screen in the dashboard or through the customer portal.
- Refunds are considered under applicable mandatory consumer rights and Paddle's current refund policy. The Paddle Buyer Terms shown at checkout govern the payment transaction and any applicable withdrawal right.
- If payment fails, Premium access may be restricted or the account may move to the Free plan after the applicable retry period; your data is retained.
- Applicable taxes and the final amount are calculated and shown by Paddle before payment confirmation.
5. Data Ownership
All farm, field, transaction, inventory and plan data you add to the Service ("User Data") belongs to you. Harmiqa makes no ownership claim over this data and processes it solely to deliver the service, perform backups and comply with legal obligations. You may export all your data via the panel (CSV / Excel) at any time while your account is active; when you close your account, your data is permanently deleted.
6. Acceptable Use
When using the Service, you agree to the following rules:
- Not to use the Service in violation of applicable law, third-party rights or public morality.
- Not to perform actions that threaten system security (automated scanning, brute-force, exploitation attempts, etc.).
- Not to perform unauthorized scraping, automated bulk requests or usage that overloads service capacity.
- Not to resell, sub-license or repackage the Service.
- Not to upload illegal content, material that breaches personal data rights, or malicious software.
- Breach of these rules may result in account suspension following a warning or immediately, and serious breaches may lead to unilateral termination of this agreement.
7. Service Level and Availability
We use commercially reasonable efforts to deliver the Service without interruption but do not guarantee 100% availability. Planned maintenance is announced in advance. Our liability for temporary outages caused by infrastructure providers such as Supabase, Vercel and Paddle is limited to the applicable contractual and legal framework.
8. Intellectual Property
The Service's software code, brand, logos, content, design and all components belong to Harmiqa and are protected by copyright, trademark and other intellectual property law. Your subscription grants a limited, non-transferable, non-exclusive license to use the Service for personal or business purposes.
9. Limitation of Liability
The Service is provided "as is". Harmiqa does not provide financial advice, tax advice or legal services. Reports, calculations, budgets and insights produced by Harmiqa are for informational purposes; for formal accounting records, tax filings or legal decisions, the user must consult their own accountant or qualified professional.
- The Service's total liability is capped at the total fees actually paid by the User to the Service in the twelve (12) months preceding the date of the breach. For Free tier users this amount is deemed zero.
- No liability is accepted for indirect damages (loss of profit, loss of data, reputational harm, etc.). These limitations do not apply to the extent they conflict with applicable consumer protection law.
10. Data Protection
Your personal data is processed under Turkish Data Protection Law No. 6698 (KVKK) and, where applicable, the EU General Data Protection Regulation (GDPR). For details see our Privacy Policy page.
Users may choose to register or sign in with Google. Google is used only for authentication, and email/password remains available. See the Privacy Policy for details.
11. Merchant of Record and Payment Provider (Paddle)
Paddle acts as Merchant of Record for Premium purchases. At checkout, the buyer enters into the payment transaction with the applicable Paddle entity, which handles payment, applicable taxes and invoicing. Harmiqa does not store card details. The Paddle Buyer Terms, Refund Policy and Privacy Notice shown at checkout apply to the transaction.
12. Account Closure and Termination
You may close your account at any time from the panel. When you close your account, your data (except records subject to a legal retention obligation) is permanently and irreversibly deleted in the same request; we recommend exporting any data you need before closing. Harmiqa reserves the right to suspend an account or terminate this agreement in cases of serious breach of these terms, payment fraud or legal obligation.
13. Changes to Terms
These terms of service may be updated from time to time. Material changes are notified to you by email or in-app notification at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the changes.
14. Governing Law and Dispute Resolution
These service terms are governed by the laws of the Republic of Turkey. This choice does not limit mandatory consumer rights under the law of the country where the consumer resides. A purchase through Paddle is separately governed by the Paddle Buyer Terms shown at checkout. Disputes under Turkish Consumer Law No. 6502 fall within the jurisdiction of the designated consumer arbitration committees or courts; for other disputes, the courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction to the extent permitted by applicable mandatory law.
